2. Agentic Chat/AI Features & Automated Support

We may offer automated chat technologies (including AI-powered or automated assistants) and AI-enabled services (collectively, “Chat Services”) to help facilitate customer support, respond to inquiries, provide product information, and assist with transactions. When you interact with Chat Services, we collect the information you choose to provide through the Chat Services, as well as information about your interaction as explained in the chart above. Certain Chat Services may involve automated processing, including tools that generate responses or assist in making recommendations or routing requests. These tools are designed to support our customer service and ecommerce operations. We do not carry out automated decision-making, including profiling, using personal data collected through our Chat Services to make decisions that produce legal or similarly significant effects about you without appropriate safeguards. Where required by law, you may request human assistance or review of certain automated interactions.

3. Sharing Your Information

As noted above, Burris consists of a family of companies that includes Burris Logistics and its Affiliates (the “Company Group”). Because Burris Logistics’ Affiliates share common ownership, management, and technology infrastructure, information collected through any Company Group website or service may reside in systems that are accessible across the Company Group, regardless of which Affiliate’s website you used when the information was collected. We maintain internal policies and access controls designed to limit use of your information to authorized purposes.

We will not sell your personal information to any third party for money. We may share your information under certain circumstances with trusted third parties that help us bring you the services we offer, as explained in the above chart.

We require our service providers to maintain the confidentiality of all information that we share with them and to use such information only in accordance with the obligations set forth in the agreements we have with them.

We may also share your personal information with law enforcement agencies, government/regulatory bodies, and content protection organizations to: (i) protect our legal rights, privacy or safety, and that of our subsidiaries, affiliates, employees, agents, contractors, or other individuals; (ii) protect the safety and security of visitors to our online services or other properties; (iii) protect against fraud or other illegal activity or for risk management purposes; or (iv) comply with the law including with subpoenas, search warrants, court orders, and other legal process.

4. Cookies and Tracking Technologies

We may place, or allow to be placed, cookies, pixels, web beacons, SDKs, APIs, and similar technologies (“Tags”) on our Sites to give you the best experience, perform analytics, analyze traffic, personalize content, offer a range of features and functionality, support account experiences, and offer ads that match your interest. Tags may be placed on the site by parties such as Google Analytics, Amazon, and Meta, as well as other providers.

We use Tags to create a better experience for you on our Sites. For example, Tags prevent you from having to login repeatedly and help maintain your account session and preferences. We also use third-party cookies, which are cookies placed by third parties for advertising and analytics purposes. You can control these cookies through your browser settings. 5. Interest-Based Advertising

We work with third-party network advertisers, analytics service providers, and other vendors to deliver our online advertisements to you and to provide us with information regarding your use of our Sites and the effectiveness of our advertisements. Our third-party service providers may set and access their own tracking technologies on your device, such as cookies and web beacons, and may collect or access information about you, such as your device’s IP address, your browser type, your operating system, date and time information, such as when you receive, open, or click a link in an email message from us, and other technical information about your device. Cookies and web beacons, including those set by third-party advertisers, may be used to target advertisements, prevent you from seeing the same advertisements too many times, and conduct research regarding the usefulness of certain advertisements to you. We may share certain information such as device identifiers, usage patterns, transaction information, and de-identified information with third-party vendors for advertising and analytics purposes. If you take steps to block advertising cookies or opt out of interest-based advertising, this does not mean that you will no longer receive ads from Burris, they just will not be tailored to present the content likely to be of the most interest to you.

6. Sale or Transfer of All or Part of Our Business or Assets

In the event of a business transaction, we may disclose personal information to prospective or actual purchasers, investors, or successor entities in connection with a contemplated reorganization or an actual reorganization of our business, in connection with financing, a sale, or other transaction involving the disposal of all or part of our business or assets, including for the purpose of permitting the due diligence required to decide whether to proceed with a transaction, pursuant to assurances of sufficient data handling practices and safeguards. We will make commercially reasonable efforts to provide you with reasonable notice of such transfer, or as otherwise required by law.

7. Data Retention

We store your personal information on the basis of applicable law and retain it as required to satisfy the purpose for which the data is processed, unless a longer period is required for purposes such as complying with retention obligations, record keeping or other commercial requirements.

8. State Privacy Rights

Depending on your state of residency, you may have the following rights related to your personal information, subject to statutory limitations:

  • Right to Know and Access: A right to request information about the personal information that we collect, use, disclose, share, and sell, including requesting the specific pieces of personal information we have collected about you. Residents of Minnesota and Oregon also have the right to request a list of specific third parties to whom we disclose personal information.
  • Right to Delete: A right to request the deletion of personal information that we have collected from you, though we may be permitted to retain personal information for certain purposes.
  • Right to Correct: A right to request that we correct inaccurate personal information.
  • Right to Opt-Out of Sales and Sharing or Using for Targeted Advertising: As explained above, we may disclose your information to select third parties to enhance your experiences with us, to improve our ability to serve you, to keep you aware of our products, services, and offers, and to tailor the offers and promotions displayed to you online by select third party advertisers to your interests. Certain laws may treat some of such disclosures as sales or as a sharing, and you have a right to direct us not to sell or share your personal information and to opt out of certain targeted advertising where information is processed across unaffiliated or differently branded websites and applications.   • Right to Limit the Use of Sensitive Information: A right to request that we use and disclose certain sensitive information only for certain purposes permitted under law.
  • Right to Opt-Out of Profiling: A right to opt out of profiling that has legal or similarly significant effects. We do not profile individuals for purposes to which this right applies.
  • Non-Discrimination: We may not discriminate against you for exercising your rights. We may, however, provide a different level of service or charge a different rate if the difference is reasonably related to the value of your information.

To exercise any of these rights, please email us at [email protected] or call us at 800-895-8135. To appeal a decision regarding a consumer rights request, please contact us using the same methods. For requests to access, delete, and correct your information, the information that you provide will be analyzed to determine whether we can reasonably verify your identity. We may need to obtain additional information from you to process your request. For example, if we determine that the information provided is not sufficient for verification, you may be prompted to answer a few questions.

For requests to access, delete, and correct your information, we will also send an email to you, asking that you confirm that we have the correct email address within six (6) days of receiving the confirmation email or your request will expire. If you do not see an email from us, please check your spam folder.

If you are an authorized agent acting on behalf of another individual, please send your request to [email protected] and include the following information about you and the person on whose behalf you are submitting the request: full name, mailing address, email address, and phone number. You should also provide proof of your authorization to act on the other person’s behalf. We will contact you for additional information once your request has been received.

There may be circumstances where we may not completely fulfill your request, as permitted under applicable law. For example, if you submit a request to delete your personal information, we may need to retain certain personal information to complete a transaction, detect fraud, or comply with our legal obligations.

9. Security

We implement a variety of commercially reasonable security measures to maintain the safety of your personal information. We take appropriate physical, electronic, technological and administrative steps and implement safeguards to maintain the security of personal information we collect. Unfortunately, however, no data transmission over the Internet can be guaranteed to be 100% secure. Accordingly, while we use commercially reasonable means to protect your personal information, we cannot guarantee or warrant the security of any information you transmit to us.

We have put in place procedures to deal with any suspected personal data breach and will notify you and any applicable regulator of a breach where we are legally required to do so.

10. Children’s Privacy

Our Sites are not intended for children. Burris does not knowingly collect any personal information from children under the age of thirteen and will dispose of any such information if we become aware that it has been provided to us. If you believe that your child under the age of 13 has submitted personal information to us in connection with our Sites, please contact us at [email protected] so that we may take steps to delete this information.

11. Marketing and How to Unsubscribe

We would like to send you information about our goods and services, which may be of interest to you. Where we have your consent or it is in our legitimate interests to do so, we may do this by email or phone call.

You may opt out of marketing emails at any time by using the unsubscribe link in our messages or contacting us. Please allow at least ten (10) business days from when the request was received to complete your unsubscribe request. Transactional or service-related messages will continue as required. Therefore, if you opt out of receiving marketing communications, you may still receive service-related communications that are essential for administrative or customer service purposes, [for example relating to order confirmations relating to your purchase, updates to our Terms and Conditions, checking that your contact details are correct].

Our Site may contain links to third-party websites whose privacy practices may differ from ours. If you choose to purchase products or services through a third-party site, including through Agentic Shopping Services, or otherwise access a third-party site, the information collected by the third party is governed by that third-party’s privacy policy. We encourage you to review the privacy policies of any other sites you visit. We are not responsible for the privacy practices or content of those third parties.

13. Customers Outside of the United States

Burris stores its information, including Personal Data as that term is defined in the General Data Protection Regulation (“GDPR”), and hosts its Sites in the United States. If you are located outside of the United States or are visiting our Sites from outside the United States, please be aware that your Personal Data will be transferred to, stored, and processed in the United States where our servers are located, and our central database is operated. The laws that apply to the use and protection of Personal Data in the United States or other countries or jurisdictions in which we transfer or process Personal Data may be different than the laws and protections in your country. By voluntarily providing us with your Personal Data and/or using our Sites, you consent to the terms of this Policy and the collection, use, maintenance, transfer to and processing of your Personal Data in the United States or other countries or territories, and, unless otherwise stated in this Policy, we use this consent as the legal basis for that data transfer. 14. GDPR Disclosure for EEA Residents

Legal Basis for Processing Your Personal Data

We process your Personal Data only if we have a legal basis to do so, including:

  2. for the performance of our contract with you, such as when you engage our services;

We employ this security measure to ensure that your Personal Data is not disclosed to any person who lacks the right to receive it.

You also have the right to receive your Personal Data in a structured, commonly used, and machine-readable format and in certain cases, to have us transmit your Personal Data to another controller.

Once we have received notification that you have withdrawn your consent, we will no longer process your information for the purpose(s) to which you originally consented unless there are compelling legitimate grounds for further processing that override your interests, rights and freedoms or for the establishment, exercise or defense of legal claims. Whenever you withdraw consent, you acknowledge and accept that this may have a negative influence on the quality of our Sites.

Fees

We reserve the right to charge a reasonable fee if your request to exercise one of your rights is unreasonable or excessive. Alternatively, we may refuse to comply with the request in such case.

No Automated Decision Making

We do not apply automated decision making or profiling techniques.
